Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and The Credit Union Wire ("The Credit Union Wire," "we," "us," or "our"), governing your access to and use of the CU Wire Data platform at cuwiredata.com, including all associated content, features, and services (collectively, the "Service"). CU Wire Data is owned and operated by The Credit Union Wire.

By creating an account, subscribing, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

Description of the Service

CU Wire Data is a subscription-based research platform that provides structured financial data, computed metrics, visualizations, and analytical tools for the credit union industry. The Service displays data derived from publicly available federal government filings and includes proprietary computed metrics such as peer percentile rankings, generated institutional analysis, radar charts, and interactive branch maps.

Important disclaimers

Not financial, investment, or legal advice. CU Wire Data is a research platform. Nothing in the Service constitutes financial advice, investment advice, legal advice, regulatory guidance, or an official credit union rating or examination. Generated institutional analysis, percentile rankings, and all other computed metrics are proprietary indicators based on publicly available data — they are not endorsements, recommendations, or substitutes for professional judgment or due diligence.

Not a credit rating agency. The Credit Union Wire is not a Nationally Recognized Statistical Rating Organization (NRSRO) and is not registered as a credit rating agency with the SEC or any other regulatory body. CU Wire Data's computed metrics and classifications are not credit ratings and should not be interpreted as such.

Not an investment adviser or broker-dealer. The Credit Union Wire is not registered as an investment adviser, broker-dealer, or financial planner with the SEC, FINRA, or any state regulatory authority. Nothing in the Service should be construed as a recommendation to buy, sell, or hold any security.

Verify independently. You should verify all information with official government sources, qualified professionals, and your own analysis before making any business, investment, regulatory, or financial decisions based on information obtained through the Service.

Eligibility

The Service is intended for use by professionals, researchers, and individuals aged 18 or older. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

Accounts, subscriptions, and billing

Access to the Service requires a paid subscription. Subscriptions are billed monthly at the rate displayed at the time of purchase (currently $10 per month for individual access, $100 per month for enterprise access) and are processed through Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

Cancellation. You may cancel your subscription at any time through your account portal or by contacting us. Cancellation takes effect at the end of your current billing period — you will retain access until that date. We do not provide prorated refunds for partial billing periods.

Price changes. We may change subscription pricing with at least 30 days' advance notice. Price changes apply to billing periods starting after the notice period. If you do not agree to a price change, you may cancel before it takes effect.

Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Each subscription is for a single individual — you may not share your login credentials or allow multiple people to access the Service through a single account. Notify us immediately if you believe your account has been compromised.

Acceptable use

You may use the Service for personal or professional research, analysis, reporting, and reference. You may include screenshots, data citations, and excerpts from CU Wire Data in your own reports, articles, presentations, and professional work. We ask that you credit "CU Wire Data" or "cuwiredata.com" when citing our proprietary computed metrics (performance benchmarks, peer comparisons, automated analysis).

Data accuracy and limitations

We make commercially reasonable efforts to ensure the data in CU Wire Data is accurate and current. All underlying financial data comes from officially published federal government sources and is updated quarterly when new filings are released. However, we provide the Service and all data on an "as is" and "as available" basis. We do not warrant the accuracy, completeness, reliability, or timeliness of any data, computed metric, or analysis.

Potential sources of error include inaccuracies in source filings, delays in government data publication, processing errors, computational errors, and limitations of the AI models used for analysis. AI-generated analysis is produced by language models and may contain factual errors, misinterpretations, or omissions. It is provided as supplementary research material and should not be relied upon as the sole basis for any decision.

Market data

Stock price data displayed in the CU Market Index is obtained from third-party data providers, may be delayed, and is provided for informational purposes only. It is not intended for securities trading purposes and should not be relied upon for the execution of transactions. We are not responsible for investment decisions made based on market data shown in the Service. The inclusion of any company in the CU Market Index does not constitute an endorsement, recommendation, or investment opinion.

Intellectual property

The underlying credit union financial data displayed in CU Wire Data is derived from public domain federal government data. However, CU Wire Data's proprietary elements — including our computed metrics, health scoring methodology, AI-generated analysis, percentile ranking algorithms, data visualizations, user interface design, software code, "CU Wire Data" name and branding, and all other original content — are the exclusive property of The Credit Union Wire and are protected by applicable copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for the purposes described in these Terms. This license does not transfer ownership of any intellectual property.

Service availability

We aim to maintain reliable access to the Service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime when possible.

Termination

We may suspend or terminate your account and access to the Service, with or without notice, if we reasonably believe you have violated these Terms. You may cancel your subscription and close your account at any time. Upon termination for any reason, your right to access the Service ceases at the end of your current billing period (or immediately, in the case of termination for violation of these Terms). Sections of these Terms that by their nature should survive termination will survive, including disclaimers, limitations of liability, intellectual property provisions, and dispute resolution.

Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE CREDIT UNION WIRE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA OR ANALYSIS WILL BE ACCURATE OR COMPLETE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE CREDIT UNION WIRE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify, defend, and hold harmless The Credit Union Wire and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

Dispute resolution

We encourage you to contact us first at the email below to resolve any disputes informally. If a dispute cannot be resolved informally within 30 days, either party may pursue formal resolution.

These Terms and any disputes arising under them shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the federal or state courts located in New York, and you consent to the personal jurisdiction of such courts.

General provisions

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Credit Union Wire regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, internet disruptions, or pandemics.

Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email (at the address associated with your account) or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription.
